A qualified SAP is a professional who evaluates Department of Transportation (DOT) employees who have violated drug and alcohol testing regulations. If you fail or refuse a DOT drug or alcohol test, you will be taken out of safety-sensitive duties. SAP professional will provide a substance abuse evaluation in order to make recommendations for the course of treatment, education, follow-up testing and/or aftercare.
The SAP’s role is to protect public safety related to transportation employers and transportation employees in safety sensitive positions.
SAP must understand alcohol and drug regulations for these six industries.
FMCSA - Federal Motor Carriers Safety Administration
FAA - Federal Aviation Administration
FRA - Federal Railroad Administration
FTA - Federal Transit Authority
USCG - United States Coast Guard
PHMSA - Pipeline and Hazardous Materials Safety Administration
The Department of Transportation (DOT), in compliance with The Omnibus Transportation Employee Testing Act of 1991, requires drug and alcohol testing of safety-sensitive transportation employees. Safety sensitive employees are required to submit to drug and alcohol testing to maintain their safety sensitive status under 49 Code of Federal Regulations (CFR) Part 40.

In accordance with 49 Code of Federal Regulations (CFR) Part 40, employers are required to test safety sensitive employees in the following cases:
During a DOT SAP Evaluation, the evaluator must do the following:
After the SAP evaluation, DOT rules require the employee to complete the course of treatment or education recommended by the SAP. After the completion the SAP’s recommendations, an individual may be considered for return to safety-sensitive duty. (However, employers are not obligated to keep them as employees and may choose to terminate their employment even if they are compliant with the SAP process).
